§ 1 Entities involved in the realization of the Contest

1. The organizer of the "Autumn Pleasures with Happymess" competition (hereinafter referred to as "Competition") is

2. The Organizer is the Promoter of the prize within the meaning of Article 921 of the Civil Code.

3. The Organizer declares that the Contest is not in any way sponsored, supported, managed or associated with entities that own Instagram® social networking site. Instagram® is not responsible for the Contest. All questions, comments and complaints related to the Contest should be addressed to the Organizer and under no circumstances to the owner or administrator of the Instagram® social networking site. This waiver of liability does not affect the Organizer's liability to the Contest participant in connection with their participation in the Contest.

§ 2 Duration of the Contest

1. The contest starts on 6.11.2020 and ends on 29.11.2020 at 11:59 pm.

2. The answers to the contest question referred to in § 5.2 of the Rules and Regulations should be sent by 15.11.2020 at 23:59. The answers sent later will not be admitted to the Contest.

§ 3 The Contest Committee

In order to ensure the proper organization and course of the Competition, and in particular to assess the correctness of applications to the Competition and to select the winners of the Competition, the Organizer will appoint a Competition Committee (hereinafter referred to as the "Committee"). The Committee will consist of 3 (in words: three) persons indicated by the Organizer.

§ 4 Conditions for taking part in the Contest

1. The Competition is open to natural persons who are eighteen years old and have full legal capacity.

2. the Contest can be participated only in person, i.e. it is not allowed to create accounts and make applications on behalf of third parties.

3. the Contest cannot be attended by employees, members of the authorities and representatives of the Organizer, the Coordinator and other entities directly participating in the preparation and conduct of the Contest, as well as persons cooperating with the above mentioned entities on a permanent basis other than the employment relationship and members of their closest families, i.e. ascendants, descendants, siblings, spouses, spouse's parents and persons who have an adoption relationship with them.

4. The participation in the Contest and the related provision of personal data is entirely voluntary. Joining the Contest is tantamount to acceptance of the provisions of these regulations. A person who has properly entered the Contest and meets the conditions of participation in it, obtains the status of a Contest Participant (hereinafter: "Participant").

5. The Contest is open to individuals who have a personal Instagram account, established and maintained in accordance with the Instagram service regulations (hereinafter referred to as: "Profile"). The Participant is not entitled to participate in the Contest from a fictional account, understood as an account containing other data than the real personal data of the individual using this account.

§ 5 Rules and course of the Competition

1. The competition is conducted on the Organizer's fanpage board, run on Instagram website at https://www.instagram.com/happymess.kids/ (hereinafter: "Fanpage").

2. The competition is about presenting favourite ways to make yourself and your child more pleasant during the autumn period and consists in the fact that Participants answer the competition question asked by the Organizer in a post on the Fanpage:

(hereinafter referred to as: "Contest Post"), and the Organizer chooses the best answer and awards a prize to its author.

In order to enter the Contest, you should observe @Happymess.kids on Instagram, like the last 3 photos on your @Happymess.kids profile, mark one individual in the comment under the contest post, have a public profile, and post the answer to your contest question in stories on your Instagram account. The account of the person participating in the contest must be public.

4. One Participant can submit an unlimited number of contest answers.

5. Only the following may be admitted to the Competition :

a. related to the subject of the Contest,

b. meeting the conditions referred to in paragraph 6 below,

c. to which the Participant holds the copyright,

d. not containing trademarks, advertising and promotional messages of third parties.

6. The Participant declares that the response published by him does not contain content that violates the law or is contrary to good morals, in particular does not violate the rights of third parties, does not incite violence, intolerance, does not contain vulgarisms or advertising content of third parties.

7. The Commission will evaluate the contest responses, taking into account the fulfilment of the formal criteria referred to in paragraph 5 above, and in particular their originality and creativity. After the assessment, the Commission will select 1 (one) main winner and 1 (one) reserve winner.

8. The main winner will be announced no later than 29.11.2020. The Organizer will announce the main winner on the Fanpage by publishing the contest work together with the account name on Instagram.

9. In order to receive the prize, the main winner should contact the Organizer within 5 (in words: five) days from the date of announcement of the Contest results and provide their data necessary to issue the prize: name and surname, place of residence and telephone.

10. if the main winner does not contact the Organizer within the time limit specified in paragraph 9 above or provides incorrect data (i.e. data that do not allow contact with him), he loses the right to the prize. In such a case the prize is forfeited and the Organizer will announce the reserve winner on the next day on the Fanpage.

11. In order to receive the prize, the reserve winner should contact the Organizer within 5 (in words: five) days from the day of announcing it and provide their data necessary to issue the prize: name and surname, place of residence and telephone.

12. If the reserve winner does not contact the Organizer within the time limit specified in section 11 above or provides incorrect data (i.e. data that do not allow contact with him/her), he/she loses the right to the prize. In such a case the prize is forfeited and remains at the Organiser's disposal.

13. The winner shall be obliged to provide his/her data: Name and surname, place of residence and telephone number, which will be necessary to release the Prize within 5 (in words: five) days from the date of receiving the message about the prize. The winner accepts the provisions of the Terms and Conditions and agrees to have his personal data processed by the Principal in order to settle the Contest by sending a statement via an Instagram® message with the content:

14. "I confirm that I have read the Competition Regulations. I agree to the processing of my personal data by the data administrator for the purpose of the Contest. I give my personal data voluntarily and declare that they are true. I have familiarized myself with the content of the information clause, including information about the purpose and ways of processing personal data and the right of access to the content of my data and the right to correct it".

15. The expression of the above mentioned consent is completely voluntary, however, the lack of consent to the provisions of the regulations and the lack of consent to the processing of personal data for the purposes of conducting and resolving the Contest makes it impossible to take part in it.

16. failure to meet the deadline specified in the above paragraph, providing incorrect data referred to in the previous paragraph shall result in the loss of the right to the Prize, which shall then remain at the exclusive disposal of the Organiser.

§ 6 Prizes

1. The prize in the Competition is a sleeping bag and two cushions with a total gross value of 707 PLN (in case of a large sleeping bag)

2. The prize element is also an additional cash prize in the amount of 11.11% of the value of a given prize intended to cover income tax on the value of the prize. This amount will not be spent on the winner, the Organizer, as the payer of the lump-sum personal income tax, will deduct it before the prize is issued and will pay it to the appropriate tax office. The winner agrees and authorizes the Organizer to make such deduction.

3. It is not possible to transfer the right to the prize to third parties. It is not possible to pay the equivalent of the prize.

4. The Organizer has the right to verify the personal data of the winners at the time of issuing the prize, in order to identify the winner, as well as to confirm his or her age, including the winner may be required to present an appropriate identity document before the prize is issued.

§ 7 Copyright

1. By sending a reply to the Competition, the Contest Participant declares that he is its author and that it does not violate any third party rights.

2. if, as a response to the contest, the Entrant sent a photo on which the image of the Entrant or a third party is recorded, the Entrant allows the Organizer to use his/her image in the manner specified in these Regulations, and also declares and ensures that he/she has the consent of the third party to submit the photo to the Contest and disseminate its image in the manner specified in these Regulations.

3. The Contest Participant, by sending a reply to the Contest, which constitutes a work within the meaning of the Copyright and Related Rights Act, grants the Organizer and the Coordinator a non-exclusive, territorially and temporally unlimited, free of charge and non-transferable license to use the reply to the Contest in order to conduct the Contest. This license is granted in the following fields of exploitation:

a) recording of the Contest answer on all the carriers available at the time of concluding the agreement and on all the carriers of digital form allowing for use by means of a computer, Internet and various multimedia techniques;

b) multiplying the Competition response using all techniques available at the moment of entering the Competition (including offset, xerographic, digital, audiovisual techniques) on the carriers referred to in point a,

c) placing on the market,

d) entering into any type of computer's persistent memory and into non-volatile memory,

e) public display, exhibition, reproduction, including posters, illuminated advertising, etc,

f) rent or lease of reproductions, regardless of the form and technique of their fixation and the material medium used or lack thereof,

g) broadcasting and re-broadcasting of works by means of wired or wireless vision by a ground station or by satellite,

h) making the competition answer publicly available in such a way that everyone can have access to it at a place and time of their choice.

4. The winner who received the prize (main or reserve), at the moment of receiving the prize, on the basis of art. 921 § 3 of the Civil Code, transfers to the Organizer the author's economic rights to the work constituting the competition answer, in the fields of exploitation indicated in par. 3 above, without time or territorial limitations and without remuneration.

5. regardless of the paragraph 4 above, the winner who received the prize (main or reserve) agrees to make changes and modifications in his or her reply to the competition and to use the developed versions of the reply to the competition to the extent indicated in paragraph 3 above.

6. The Organizer has the right to use the awarded answer within the scope specified in sec. 3 above both with and without giving the name of the winner.

7. The Organizer has the right to transfer the rights obtained in accordance with paragraphs 3-4 above to other entities.

§ 8 Rights and obligations of the Organiser

1. The Organizer reserves the right to exclude from participation in the Contest or to deprive the winner of the prize if the actions of these persons are contrary to the law, good manners or these Regulations, in particular if these persons:

a. do not act personally, but through third parties;

b. are minors;

c. if claims of third parties have been made against their competition response, whose legitimacy has been established, in particular as regards the dissemination of the image of the person recorded in the competition response or the infringement of copyright.

2. In order to clarify doubts related to the Entrant's activities in the Contest, the Organizer may contact the Entrant using the means of communication provided by the Entrant (e.g. e-mail correspondence); during such a contact, the Organizer may expect the Entrant to provide detailed information concerning his/her participation in the Contest.

3. The Organizer may entrust the Coordinator with the technical activities related to the conduct of the Contest and the handling of the complaint.

§9 Processing of personal data

1. The entity responsible for processing your personal data is:

2. The person responsible for supervising the data processing at DHJ Daria Romankiewicz-Hańska is Daria Romankiewicz-Hańska. Full correspondence concerning the exercise of the rights under paragraphs 7 and 8 below should be sent in writing to the address:

3. The responsible party and the service providers it engages process your personal data for the following purposes:

a) carrying out promotions, competitions or rebate actions in accordance with the relevant terms and conditions of promotions, competitions or rebate actions (legal basis: performance of the contract),

b) preserving and defending our rights (legal basis: legitimate interest on our part in the investigation and defence of our rights),

c) fulfilling obligations under separate legal regulations (legal basis: fulfilling our legal obligations).

4. your personal data will only be transferred by us to other responsible parties if this is necessary for the performance of the contract or if the third party has a legitimate interest in the transfer of the data or if there is your consent.

5. your data is stored for as long as required for the performance of the services specified in these rules. After this period, your data is deleted with the exception of those data which we have to retain in order to fulfil our legal obligations (e.g. due to tax law, commercial retention periods.

6. We would like to inform that you are entitled to:

a) The right to information: You have the right to receive information from us on the processing of your data. For this purpose, you may assert your right to information with regard to your personal data that we process.

b) Right of correction and deletion: You may require us to correct incorrect data and, provided that statutory requirements are met, to complete or delete your data. This does not apply to data which is necessary for billing and accounting purposes or which is subject to a statutory duty of storage. However, if you do not need access to this data, the processing thereof is restricted (see below).

c) Restriction of processing: You may require us to restrict the processing of your data, provided the statutory requirements are met.

d) Objection to the processing of data: Furthermore, you have the right to object to the processing of your data by us at any time. We will then stop the processing of your data unless we can demonstrate - in accordance with the statutory requirements - sufficient and protected reasons for further processing that prevail over your rights.

e) Objection to direct marketing: You may also object to the processing of your personal data for advertising purposes at any time ("objection to advertising"). Please note that for organisational reasons, there may be an overlap between the revocation of your consent and the use of your data in the context of an ongoing campaign.

f) Objection to the processing of data on a legal basis in the form of a legitimate interest: Furthermore, you have the right to object to the processing of your data by us at any time, provided that the processing is based on a legitimate interest. We will then stop the processing of your data, unless we can demonstrate, in accordance with statutory guidelines, sufficient and protected reasons for further processing that prevail over your rights.

g) Revocation of consent: If you have given us your consent to the processing of your data, you may revoke your consent at any time in the future. The lawfulness of the processing of your data until your consent is revoked remains unaffected by this.

h) Data transferability: You also have the right to receive the data you have made available to us in a structured and commonly used machine-readable format or, as far as technically feasible, to request the transfer of your data to a third party.

8. In the event that any of the activities carried out under the promotion require your separate consent for processing, you have the right to withdraw your consent at any time, which will not affect the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal.

9. If you find that the Responsible Party is processing your data in breach of the law, you have the right to lodge a complaint with the supervisory authority.

11. In case you have given additional approvals for processing during the registration process, all information concerning this process will be made available to you during the declaration of will.

§ 10 Complaints

1. Each Participant has the right to lodge a complaint during and after the Contest, but no later than 30 days after the end of the Contest (the date of receipt of the complaint by the Organizer or Coordinator is decisive).

2. Complaints should be submitted by e-mail with the title "Complaint - Competition" to the Coordinator's address or by sending a private message addressed to the Happymess.Kids fanpage on Facebook or Instagram.

3. Complaints will be dealt with within 14 (in words: fourteen) working days from the date of their receipt. The Participant will be informed about the Organizer's decision by e-mail or registered letter sent to the address given in the complaint.

4. The complaint should include the name, surname, address of the person lodging the complaint and a description of the reasons or reasons for the complaint, as well as the expected manner of its consideration.

5. complaints will be considered by a complaints committee appointed by the Organizer.

§ 11 Final provisions

1. These Regulations are available on the Fanpage and at the Organizer's headquarters. The Organizer reserves the right to change the Regulations and extend the duration of the Contest at any time, provided that this does not violate the rights acquired by the Participants and does not affect the course of the Contest.

2. The Contest Participants are not entitled to remuneration for participation in the Contest.

3. The Contest is not connected during its duration with other offers, promotions, competitions or special actions organized by the Organizer, unless the regulations of a given offer, promotion, competition or special action state otherwise.

4. All disputes arising from the performance of obligations related to this Contest will be settled by a competent common court.
